I am seeing many home food selling adds here nowadays.. Is it legal here (in US) to sell food without any Health Dept licence ? or do they have licence ? In case they dont have licence and anything happens (food poisoning etc) , who is responsible ? Can we sue them ? (I think even cant sue because of buying food from un-authorized vendor)

It is not legal. You need to prepare your food in a commercial kitchen in order to sell it. On top of that you will need various licenses. You should contact the city for specific information.
